SQG/LQG conduct weekly inspections.  Verify hazardous waste generator status, review and update contingency plan annually. Universal Waste: Conduct training annually.  Confirm that storage times do not exceed one year. Wastewater (NPDES/SDS): Discharge reports are required to be submitted at regular intervals, per permit requirements. SPCC Plan: SPCC Plans must be updated every five years or whenever there is a change in oil storage or spill potential. Conduct and document routine inspections and annual training. Air Permits/Emission Inventories: Submit all construction permit applications; Title V operating permit applications & modifications; notifications of start of construction and start of operation electronically on DEP’s Electronic Submission System (ESS). EPCRA TRI: Begin collecting data for RY2024 for reporting over 100 pounds of 189 specific PFAS chemicals (there is no de minimis exemption). Universal Waste: Conduct training annually.  Confirm that storage times do not exceed one year. Wastewater (NPDES/SDS): Discharge reports are required to be submitted at regular intervals, per permit requirements. SPCC Plan: SPCC Plans must be updated every five years or whenever there is a change in oil storage or spill potential.  Conduct and document routine inspections and annual training. Air Permits/Emission Inventories: Permits issued by the Department of Air Quality (DAQ) often require annual or semi-annual reports.  In addition to semi-annual reporting, the DAQ Web Survey (kind of like an emissions inventory but they only ask for production/fuel usages and do the calculations for you) is due in March, however, there is no set due date and it changes each year.  The facility’s reporting, recordkeeping, and monitoring requirements are explicitly stated in the issued permit. EPCRA TRI: Begin collecting data for RY2024 for reporting over 100 pounds of 189 specific PFAS chemicals (there is no de minimis exemption). Savannah, Georgia Industrial Complex Recognized for Brownfields Redevelopment OLATHE, Kan.Terracon, an employee-owned firm with a long history of providing excellence in engineering consulting services, announces it has been recognized with a 2023 Environmental Protection Agency (EPA)  Phoenix Award for the SeaPoint Industrial Terminal Complex project in Savannah, Georgia. The awards were presented to practitioners for projects that reflect the progression of brownfield redevelopment at the recent National Brownfields Training Conference (Brownfields 2023) in Detroit. The National Brownfields Training Conference brings together stakeholders from government, industry, and the community to share knowledge and best practices on the remediation and redevelopment of contaminated properties, known as brownfields. What the August 2023 Rule Amendment Means for Future Solar Projects

Waters of the U.S. (WOTUS), including wetlands, are significant environmental considerations for new solar projects. The discussion on the final interpretation of the WOTUS rule continues, even after the U.S. Supreme Court’s May decision in Sackett v. Environmental Protection Agency (EPA). Terracon’s WOTUS subcommittee, a team of environmental professionals from across the country, has continuously monitored the status of WOTUS rulings for nearly three years. Here’s a breakdown of the latest updates, and what they mean for renewable energy companies, utilities, and solar project developers/owners.

Latest WOTUS Rule Amendment Loosens Federal Wetland Regulations

Amendments to the WOTUS rule were announced on August 29, to be consistent with the Supreme Court’s May Sackett v. EPA decision. (more on that decision below). The most notable amendment states that adjacent waters must have a “continuous surface connection” to be considered federally jurisdictional. The amendment may result in more developable land without the need for federal permitting in situations where a continuous surface connection between resources is not present. Information around the most recent amendment continues to trickle out, and it’s important to note that nothing is finalized yet. “Presently, approved jurisdictional waters are not being issued. They won’t start being issued again until the amendment is published in the federal register, which could happen in a matter of weeks,” said Andy Ruocco, principal and environmental department manager in Charleston, South Carolina, and WOTUS subcommittee lead. He also noted that the timeline is a best-case scenario. Potential court challenges in the coming weeks could delay the publication process.

Supreme Court Decision Sets Stage for WOTUS Future

The Sackett v. EPA decision, issued in May 2023, was a significant departure from the previous WOTUS definition that went into effect in March of 2023. The Supreme Court ruled that waters regulated by the Clean Water Act must have a “continuous surface connection” to lakes and rivers that affect interstate commerce. Furthermore, the significant nexus test and its associated requirements/parameters have been removed from the new Amendments to the “Revised Definition of ‘Waters of the United States” (Sackett decision).

Clients in the South and Southeastern U.S. to benefit from expanded services and resources OLATHE, Kan. – Terracon, an employee-owned firm with a long history of providing excellence in engineering consulting services, is pleased to announce it has acquired Pollution Management Inc. (PMI), an engineering and environmental services firm with locations in Little Rock and Fayetteville, Arkansas. Since its founding in 1988, PMI has provided a range of engineering, environmental and field services to clients. The firm’s team is comprised of professional engineers and geologists, environmental scientists, and construction/remediation specialists who work together to provide turnkey projects throughout Arkansas and the surrounding states. “PMI enhances and strengthens our engineering and consulting practice in Arkansas and brings in- house construction capabilities that support our design services,” said Gayle Packer, Terracon chair, president, and CEO. “We are pleased to welcome them to Terracon as we grow and continually evolve how we help solve our clients’ challenges.” PMI’s 37 employees will immediately become part of Terracon. The firm will continue to operate locally as Pollution Management Inc., A Terracon Company, and the transition will be seamless for clients. The new acquisition is supported by Terracon’s existing operations in Little Rock and Rogers, Arkansas; Springfield and Joplin, Missouri; and Oklahoma City and Tulsa, Oklahoma. “By joining Terracon, our clients will continue to benefit from the expertise and creative solutions we have provided for over 34 years, while also enjoying expanded access to Terracon’s national resources and multidiscipline services,” said Richard Davis, president, PMI. “PMI’s team members will be a great fit in Terracon’s team, and will continue to grow their careers, and enhance client relationships, and add services for our clients,” said Doug Ford, vice president, PMI. PMI is Terracon’s second acquisition in 2023, and its 19th acquisition since the beginning of 2017.
